In response to recent Ontario government revisions to the Construction Act, the OAA and the Ontario General Contractors Association (OGCA) have jointly issued an updated version of “OAA-OGCA Take-Over Procedures” document. This updated resource, published on June 15, is also known as “Document 100-2026.”
Despite Document 100 being updated in November 2025, it was anticipated that the changes to the Construction Act, which came into effect on January 1, 2026, would require further updates.
Available for free on the OGCA Website, Document 100 was written with contractors and members of the architecture profession in mind, and is also intended as an educational resource for clients, lawyers, consultants, and subcontractors. The OAA and OGCA encourage their members—the architectural profession and industrial, commercial, and institutional (ICI) contractors, respectively—to use these take-over procedures and have them coordinated with the contract documents from the outset of each project.
Document 100-2026 incorporates changes required to be compatible with the latest version of the Construction Act. Updates include:
- updating title page with new version year and OGCA’s updated logo, along with minor formatting and typographic adjustments;
- updating the Application, Introduction, and General Notes sections;
- editing the Definitions section (e.g. replacing “Construction Trade Newspaper” with “Construction Trade News Website,” etc.);
- updating the Significant Statutory Requirements section;
- adding a subtitle in Stage 3 Section (refer to 3.3);
- updating Stage 4 section to refer to websites instead of newspapers;
- updating Stages 5, 7, and 8 sections to align with Construction Act requirements;
- adding, in Appendix B, a user-selectable option to address the different procedures that apply depending on whether substantial performance has been certified;
- adjusting the graphics in Appendix D, Take-Over Timelines, to match the revised text; and
- adding, in anticipation of the increased use of contractual holdbacks, the word “statutory” before the work “holdback” to avoid confusion in the future.
For the sake of existing contracts entered under previous versions of the Construction Act, earlier versions of Document 100 will remain available on the OAA and OGCA websites for the time being. These legacy versions will be later withdrawn.
Practices should ensure construction contracts reference and project team members use the appropriate version of Document 100 for each project. Legal counsel should be consulted to confirm which version aligns with the applicable version of the Construction Act for a given project.
The updates to the new Document 100 also included consultation with members of the OAA Practice Resources Committee, the OGCA board, and external legal counsel.
