Description
The purpose of the OAA-OGCA Take-Over Procedures (referred to as Document 100) is to recommend standard procedures to facilitate the closing stages of a construction contract and the take-over of the project by the Owner from the Contractor.
These procedures have been prepared jointly by the Ontario Association of Architects and the Ontario General Contractors Association, have been reviewed by legal counsel, and subsequently approved by the Associations’ governing bodies. These documents are intended as educational guidelines for all the stakeholders in the project including the Owner, Consultants, Contractors and Subcontractors. The Associations recommend the appropriate version of these procedures be used by their respective members and Owners/Clients.
The appropriate version must be determined for each project based on the transition rules in effect, the project initiation date and court rulings.
Legislative Change: Updated Construction Act Now In Force
Effective January 1, 2026, significant amendments to the Construction Act and its associated regulations came into force, affecting both contracts for professional services and for construction.
Work is underway to update OAA documents to reflect these changes.
